Abstract

The expansion of digital technologies has transformed the nature of communication, political participation, and social interaction across the world. Social media platforms, messaging applications, and online forums have created unprecedented opportunities for individuals to share ideas and participate in public discourse. However, these technologies have simultaneously generated new spaces where harassment, intimidation, and abuse occur with increasing frequency. Women are disproportionately targeted in such online attacks, which range from cyber stalking and cyber harassment to the non-consensual dissemination of intimate images and threats of sexual violence. These acts collectively constitute online violence against women and represent a major socio-legal challenge in contemporary digital societies.

This article examines the phenomenon of online violence against women through a doctrinal and socio-legal lens. It analyses constitutional protections available in India, statutory provisions governing cyber offences, and judicial responses to digital harassment. The article also explores significant Indian case studies that illustrate the practical implications of cyber harassment laws. Further, it undertakes a comparative analysis of international regulatory frameworks such as the European Union’s Digital Services Act and the United Kingdom’s Online Safety Act. The study argues that while India possesses a basic legal framework addressing cyber offences, enforcement gaps and regulatory limitations continue to undermine effective protection for women in cyberspace. Strengthening legal mechanisms, improving institutional capacity, and enhancing platform accountability are essential steps toward creating safer digital environments.
